Level Up Studio Co., Ltd.(“Company”) considers users’ privacy important and is making its best efforts to protect users’ privacy rights.
This Privacy Policy (this “Policy”) explains how information (including personal information) and data provided by users or collected by the Company are collected, stored, used, and managed when users access the Company’s games and related services (collectively, the “Services”) provided on mobile platforms (for example, iOS and Android).
The scope of this Policy is limited to data and information collected or received by the Company while users use the Services. The Company does not take responsibility for third-party companies or users’ behavior, the content of such sites, the information or data provided by users to such sites, or the products or services provided by such sites. Links within the Services do not indicate that such parties or companies are sponsored by or affiliated with the Company.
By using the Services, users agree to this Policy and to the processing of users’ information and data including personal information in the manner provided in this Policy. If you do not agree to this provision, please do not use the Services.

Personal information provided to the Company in forms filled out by users when using the Company’s Services or creating an account with the Company, such as users’ email address, name, age, location, or gender
Details of users’ use of the Company’s Services and resources accessed by users (such as users’ country of location, the time when users play the Company’s games, or information about the devices used to access the Company’s Services)
When users contact the Company, or respond to messages and communications sent by the Company, the Company may record the contents of such communications
Communications that users have with the Company on the Company’s social media channels
And, as described in detail below, information collected by the Company through cookies and other similar technologies
If users allow the Company to communicate with third-party social networks, the Company may collect and process personal information about users provided by such social networks, such as names and IDs used by users on such social networks, users’ email addresses, profile photos, and contact lists
Advertising identifiers of users permitted for use as described below
The Company and its marketing and outsourcing partners, affiliates, or analytics service providers use technologies such as cookies, beacons, scripts, and tags to identify users’ computers/devices and “remember” users’ visit contents such as users’ preferences or usernames and passwords.
Information contained in cookies may be linked to personal information such as users’ user IDs to improve the quality of the Company’s Services, to create recommended information tailored to users’ interests, and to make the use of the Services more convenient. Users may disable cookies at any time, but may not be able to access or use the functions of the Services.
The Services provided by the Company include social media features such as Facebook Like buttons and Share buttons. These features may collect users’ IP addresses and the pages visited by users within the Company’s Services, and may set cookies so that such features function properly. Social media features and widgets are hosted either by third parties or directly within the Company’s Services. Users’ interaction with such features is governed by the privacy policy of the company providing such features.
Such contact information is used only for the purpose of sending communications to recipients. If such information is stored by the Company, users or third parties may request deletion of such information from the database by contacting the Company.
In addition, the Company may collect information from (1) users’ access to and participation in message boards of the Services, (2) users’ participation in surveys related to the Services, or (3) users’ participation in events such as prize events through the Services.
The Company may provide users with opportunities to participate in prize events or contests through the Services. If users participate, the Company requests certain personal information from users. Participation in such prize events is voluntary, and users may choose whether to disclose such information. The requested information generally includes contact information (for example, name and shipping address) and demographic information (for example, postal code). The Company uses this information to notify winners and prizes, monitor traffic, or personalize the Services. The Company may conduct prize events or contests through third-party service providers. Such companies may not use users’ personal information for other purposes.
Users agree that the Company (or vendors or affiliated companies acting only in accordance with the Company’s instructions on behalf of the Company) may use users’ personal information for the following purposes:
– To contact users as part of customer service, or to send updates regarding the Company’s Services to users, or to send push notifications to users if users have agreed to receive notifications from the Company
– To manage users’ accounts and the relationship between users and the Company, and to improve users’ experience when users use the Company’s Services
– To conduct research, surveys, or interact with users by sending communications (including sending emails)
– To market or promote the Company’s Services or related products for the Company or third parties by sending communications (including sending emails). The Company may also send users information about products related to the Company’s Services. – To create reports, analyses, or similar services that the Company uses for research or business information purposes, such as tracking potential issues or trends in the Company’s Services
– To prevent deception, crime, or fraud
– Or otherwise as explicitly set forth in this Privacy Policy or as required by law
While users use the Services, information such as device operating system, Internet Protocol (IP) address, access time, browser type, and language may be automatically recorded. The Company may use such information to monitor, develop, and analyze users’ use of the Services.
The Company may request users to submit personal data including users’ name, profile photo, gender, age or date of birth, links to users’ profiles on social networking websites, and other personal data including usernames, email addresses, and postal addresses. The Company may use this information to create user profiles and provide the Services.
The Company may contact users via email to inquire about users’ experience within the Services and to notify users of the Company’s news and promotional events. Users’ gender and date of birth may be used to analyze user trends and for specific promotional purposes.
The Company may provide publicly accessible blogs, private messages, or community forums within the Services. Please note that information provided by users in such areas may be read, collected, and used by others who access them. To request removal of users’ information from such forums, users must contact the Company. In some cases, the Company may not be able to remove users’ personal information, and in such cases, users will be informed that their information cannot be removed and the reason why.
If users choose to use third-party services such as Facebook to use forums operated by the Company, the information provided by users is linked to such service accounts, and for inquiries related to such personal information, users must contact the relevant service directly.
The Company may contact users using the email address used when users contacted the Company’s customer service group in order to inquire about users’ experience in the Company’s games and to notify news and promotional events.
Users’ postal addresses are used when the Company has goods or other promotional printed materials to send to users. If users no longer wish to receive such promotional materials, users may opt out at any time by sending an email to the contact information provided in this Policy.
The Company shares users’ information with third parties (for example, affiliated companies or vendors of the Company as specified below) only in the following cases:
– Where users have given consent (including where consent is given in accordance with this Privacy Policy)
– Where it is reasonably necessary to provide Services to users (for example, where the Company provides users’ personal information to vendors used by the Company to perform Services or contact users)
– Where it is necessary to perform users’ transactions (for example, where the Company must provide users’ personal information to the Company’s payment processors to process payments)
– Where users’ identity cannot be personally identified from such information, that is, where users’ information is used as anonymous statistical information
– Where users provide information as part of a competition or otherwise to communicate with the Company’s social media channels (for example, where users provide recommendation posts regarding the Company’s Services), the Company may publish the information submitted by users along with users’ name and country of origin on the Company’s Service screens and social media channels
– Where the Company reasonably believes that it is permitted under laws or regulations
– Where it is necessary to comply with legal obligations, or to enforce or apply the Company’s terms of use or other agreements entered into with users, or to protect the rights, property, or safety of the Company, the Company’s users, or others, such as by providing users’ information to fraud prevention agencies or other organizations responsible for preventing crime or fraud
– Where there is a sale of the Company’s assets or corporate restructuring, a change of control in the Company or one of its affiliated companies, or in preparation for such cases. A third party that becomes the counterparty to the transfer or sale of the Company’s assets may have the right to continue using personal information and other information provided by users to the Company in the manner set forth in this Privacy Policy. Except in such cases, the Company does not sell or rent users’ information to third parties.
When users use the Company’s games or applications on mobile platforms, the Company may record certain information and data such as users’ application usage, access, session time, in-app purchases, users’ unique device ID (persistent/non-persistent), hardware type, Media Access Control (“MAC”) address, International Mobile Equipment Identity (“IMEI”), operating system (“OS”) version, device name, email address (if connected to Facebook or Google+), and users’ location (determined based on Internet Protocol (“IP”) address). This information is useful for troubleshooting and helps in understanding usage trends and improving and optimizing the Services and users’ experience, and may also be used for other purposes such as internet-based advertising described in this Policy.
In addition, the Company creates a unique user ID to track users’ use of the Services. This unique user ID is stored in connection with users’ profile information so that the Company can track the games played by users.
The Company may occasionally send push notifications through mobile applications to send game updates, high scores, and other service-related notifications that may be important to users. Users may opt out of receiving such communications at any time through device settings.
With users’ explicit consent, the Company or its partners may collect precise location-based information (GPS) to match users with other players in the same area, modify content according to users’ region (for example, event notifications), display users’ region to other players, and provide interest-based advertising described elsewhere in this Policy. Other players in the game may be able to see that users are available to play when users participate in certain areas of the game. Participation in this part of the Services is not a required condition for all gameplay but may be required for participation in local gameplay with other players in the area.
The Company may provide, enable, customize, and optimize advertisements and promotional information that are more relevant to users and based on users’ game and device usage, online behavior, and interests, including both advertisements created by the Company itself and advertisements created with the help of other partners, and may collect and use data and information about users and users’ devices related to such advertisements, including views of advertisements and interactions with advertisements (including whether applications exist on devices or are in use at certain times). In addition, the Company and its partners may use cookies or similar tracking technologies to track content accessed by users or users’ device location for interest-based advertising purposes. The privacy policies of the Company’s partners may include additional terms and disclosures regarding data collection and use and tracking technologies, and we recommend that users review those policies for more details.
Advertising providers on mobile devices and the Company’s third-party advertising and analytics partners may also collect and use advertising IDs to enable and optimize advertisements. Advertising IDs are non-permanent device identifiers such as Android Advertising ID and/or Apple’s Identifier for Advertising.
Such advertising providers and third-party advertising and analytics partners may collect and use data and information about users such as users’ service session activity, advertisement views and interactions, device identifiers, MAC address, IMEI, geographic location information, and IP address in order to analyze, track, and measure advertisement performance and provide interest-based advertising.
In addition, users may see advertisements for the Company’s Services advertised on other services. If users click on one of these advertisements and install the Company’s game, users become users of the Services. To verify installation, device identifiers may be shared with advertising providers or third-party advertising or analytics partners.
Most of the Company’s partners that enable online activity or interest-based advertising are members of one or more self-regulatory programs of the digital advertising industry. By clicking on Network Advertising Initiative (“NAI”) and Digital Advertising Alliance (“DAA”) below, users can learn more about customized or interest-based advertising and opt out of certain targeting programs.

The Company does not share users’ personal information except where users have approved or as described below:
– The Company may enter into contracts with other companies and individuals to have them provide services on behalf of the Company. Examples of such services include data analysis and provision of customer service. These entities and service providers may have access to users’ personal information in connection with the performance of the Company’s Services.
– The Company may disclose users’ information where it deems it appropriate to do so as permitted by law, such as in response to a subpoena, or to comply with laws, investigate fraud, respond to government requests, enforce or apply the Company’s rights, or protect the rights, property, or safety of the Company, the Company’s users, or others. This includes exchanging information with other companies and organizations for fraud prevention purposes. In some cases, the Company may be required to disclose personal information in response to lawful requests by public authorities or local law enforcement.
– The Company may share users’ information in connection with a merger of the Company, sale of assets, or financing or acquisition of all or part of the Company’s business by another company. Users will be notified via email and/or notice within the Services regarding any change in ownership or use of personal information.
– The Company may share aggregated or anonymized information about users with advertising companies, publishers, business partners, sponsors, and other third parties.
Upon request, the Company will provide information regarding whether the Company holds users’ personal information. If users’ personal information changes, or if users no longer use the Company’s Services, users may correct, update, delete inaccurate information, or request deletion of personal information by changing account settings or contacting the Company. In some cases, the Company may not be able to remove users’ personal information, and in such cases, users will be informed that their information cannot be removed and the reason why. The Company will respond to users’ access requests within an appropriate period of time.
Users may opt out of receiving advertising emails from the Company by following the instructions included in such emails or by sending an email to the contact information provided in this Policy. Even if users opt out of receiving advertising emails, the Company may still send non-promotional emails such as those related to users’ accounts or ongoing business relationships.
In addition, users may opt out of receiving SMS notification messages sent by the Company through SMS or email.
– The Company destroys personal information without delay when such personal information becomes unnecessary due to expiration of the retention period or achievement of the processing purpose.
– Where the Company receives personal information from third parties, the Company provides notice regarding such matters, and users have the right to request suspension of processing of personal information in accordance with Article 37 of the Personal Information Protection Act. However, if the processing of personal information is suspended, use of the Company’s Services may not be possible. Requests for suspension of processing of personal information may be made through help@levelupdevs.com. In addition, personal information provided with separate consent will be destroyed without delay when the retention period expires or the purpose of use is achieved.
– The procedures and methods for destruction of personal information are as follows:
Destruction procedure: Users’ information is stored for a certain period after the purpose is achieved in accordance with internal policies and other related laws, and then destroyed.
Destruction method: Personal information recorded/stored in electronic file form is destroyed so that the records cannot be reproduced, and personal information recorded/stored in written form is destroyed by shredding or incineration.
The Company does not use “cookies” that store and retrieve users’ information at any time.
The Company takes appropriate measures to protect users’ information from unauthorized access or loss, misuse, or alteration by third parties.
The Company makes sincere efforts to store information collected from the Services in a secure operating environment that is not disclosed, but cannot guarantee absolute security of information during transmission or while stored in the Company’s systems. In addition, while the Company strives to ensure the integrity and security of networks and systems, it cannot guarantee that its security measures will prevent attempts by third-party “hackers” to illegally obtain access to such information. The Company does not guarantee or represent that users’ information will be protected from loss, misuse, or alteration by third parties. No method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, the Company cannot guarantee absolute security.
The Company retains users’ information while users’ accounts are active and as necessary to provide Services to users. In addition, the Company may retain and use users’ data as necessary to comply with legal obligations, resolve disputes, and enforce agreements.
The Company does not knowingly collect or request personal information from children under the age of 13, target such children for interest-based advertising, or knowingly allow such children to use the Company’s Services. If a user is under the age of 13, please do not send personal information such as name, address, telephone number, or email address to the Company. Children under the age of 13 may not submit personal information. If the Company becomes aware that it has collected personal information from a child under the age of 13, the Company will delete such information as soon as possible. If you believe that the Company may have collected information from a child under the age of 13, please inform the Company.
The Company may update this Policy to reflect changes in data and information protection policies. If there are significant changes, the Company will notify users before such changes take effect via email (sent to the email address specified in users’ accounts), or by posting notices within the game and official communities. Users are encouraged to periodically review the latest information regarding the Company’s Privacy Policy.
